HOUSE RULES of Ocean Towers, Inc.

(Adopted by the Board 4/1/2014)

In the interest of the peaceful enjoyment of our building by all, residents and visitors must observe the rules and regulations of the Association as well as the common courtesies that make for successful cooperative living. The Association’s rules governing specific topics are outlined below. More broadly, cooperative living requires respect for your neighbors’ desire for peace and quiet as well as for a certain amount of privacy.

Copies of all rules and regulations governing Ocean Towers are available from the Property Manager. You may also contact any Board member to discuss any questions or concerns.

PARKING

The parking spaces at Ocean Towers are a limited common element of the Association. No parking space is permanently assigned to any individual apartment or owner. Allocation of the parking spaces is made annually based on written rules and a fee structure and administered by the Property Manager with the assistance of the Board. The rules give first priority to owners in residence at Ocean Towers; secondary priority is given to owners whose apartments are occupied by a tenant. The Property Manager can provide you with a copy of the rules governing parking and an application form.

RENTING

Owners may rent their apartments to non-owners only under the terms spelled out in the association’s bylaws, and only with prior approval of the prospective tenant by the association’s Board. Leases must be for a minimum of six months. A damage deposit equal to one month’s rent is required at the time of approval. The association's rental application form and the standard Florida lease form are available from the Property Manager. Once completed, these forms must be delivered to the Property Manager who will run credit and background reports and review the application with the Board of Directors.

GUESTS

Given our location at the beach we recognize that owners and tenants may wish to have overnight guests, or may wish to make their apartments available to friends or family in their absence. However, any individual who resides in an apartment for one month or more in the absence of the owner will be considered by the Association to be a tenant subject to the formal review and approval process described in the RENTING section of the Association’s rules.

Under no circumstances may a unit be occupied by more than two individuals (in the case of studio apartments numbered -02 to -07) or three individuals (in the case of the one-bedroom apartments numbered -01).

NO COMMERCIAL USE

Ocean Towers is a residential building. No apartment or common area of the building may be used for commercial purposes.

SECURITY

The safety of residents in the building is a prime concern of the association. Except for times during the day when maintenance staff may have the front door blocked open for their convenience, all doors to the street (including garage gates) should be locked at all times. Do not give building keys or entry codes to non-residents.

WALKWAYS AND OTHER COMMON AREAS

Fire regulations require that walkways be kept clear. Any furniture placed on the walkways must be readily removable (i.e., lightweight and collapsible) and appropriate for outdoor conditions. Items on the walkway also must not damage the building (walls, railings, steel posts, etc.) or detract from the appearance of the building. Large plants, sporting equipment, towels, clothes, cleaning equipment, etc. must not be left in the walkways or hung on the railings. Except when you are in the building, all personal items should be kept inside your apartment.

Smoking is not allowed on the walkways and other common areas. Cell phone use on the walkways and other common areas may be intrusive to other residents and should be avoided.

AIR CONDITIONERS

Owners and residents are required to maintain air conditioning units and unit covers in good condition. Air conditioners which project excessively into the walkways or generate excessive noise will not be permitted.

It is the responsibility of owners and residents with air conditioning units along the walkways to maintain air conditioner condensation collection containers to prevent condensation from dripping on the walkways and creating a slip hazard. Owners and residents must:

• Ensure that the container is large enough and in proper position to collect condensation from the air-conditioner.

• Ensure that the container is emptied regularly and does not overflow.

• Empty the container in the apartment (not over the balcony) so as not to inconvenience other residents.

REMODELING/RENOVATIONS

The Property Manager must be informed in advance of any planned remodeling or renovations in an apartment. The Property Manager will advise the Board of the plans, and the Board must have the opportunity to review, approve, disapprove, or recommend changes before any work is commenced or permits sought. Any remodeling or renovations in apartments must be permitted by the City of Miami Beach and any other relevant agencies.

PETS

Owners in residence may have one or two cats. Dogs and other animals are not allowed. Tenants may not have pets.

VIOLATIONS

It is the responsibility of owners and residents to comply with the rules of the Association. Owners with tenants or guests are responsible for the actions of those tenants or guests that may affect the Association. Ocean Towers, Inc. reserves the right to impose fines, retain damage deposits, and pursue legal action if necessary and to the maximum extent allowed by law to enforce the rules of the Association. Any attorney’s fees and expenses incurred by the Association in the enforcement of the Association’s rules will be charged to the owner responsible for the violation.
